Violations and Enforcement
Owners and operators of an underground storage tank(s) found in violation of the
Los Angeles County Code Title 11, Division 4, Chapter 11.86 ENFORCEMENT and/or
California Health and Safety Code Division 20, Chapter 6.7, Section 25299 (PDF, 13KB) are subject to enforcement. Those owners and
operators who do not respond immediately to notices issued by the Los Angeles County Department of Public Works Environmental Programs Division and come into compliance will be referred to the
Los Angeles County District Attorney's office for enforcement. All violations will be pursued and will be prosecuted.
In addition, if owners and operators are found to be in "Significant Violation", the Los Angeles County Department of Public Works also has the authority to affix Red Tags to USTs, as per the California Code of Regulations, Title 23, Division 3, Chapter 16, Article 10.5. Permittees of USTs that have been Red Tagged per California Code of Regulations, Title 23, Division 3, Chapter 16, Article 10.5, are subject to the Permit Noncompliance Fee as set forth in Los Angeles County Code Title 11, Division 4, Chapter 11.82.014.
